    I have a comment about the court process and the Judge calling names to a Plaintiff in open court. Is this defamation of character? Does it not count when later the directions given to the plaintiff in the Judge’s emotional outburst are then denied when they obstructed the understanding of the order and how it was to be followed? What measures if any can be taken? Are there no rules of respect or rights for untrue statements in court??

      You raise good questions that will be of interest to others, so I am responding here. You posted to a public blog so I assume you want the answer posted here as well, but your comments were a little specific, so I have edited them slightly to keep you anonymous.

      ANYTHING said in the litigation process is absolutely privileged, and will not support a new legal action. This is an essential rule, because without it every action would spawn many more actions. Indeed, think about it. If you COULD sue someone for something that was said in court, then you would pretty much have to sue them, lest your failure to do so be perceived as acceptance of what what said. Here is a very detailed article on the subject of collateral actions and why they are not permitted.

      That does not leave you without remedy. Judges, like attorneys, are governed by a code of conduct. One of the rules for judges states that they must treat all parties with respect. It won’t impact your case in any way, but you should file a complaint with the Commission on Judicial Performance. Neccesarily, judges are given a lot of lattitude and complaints sometimes fall on deaf ears. At the conclusion of just about every case, one side is going to hate the judge and be convinced he was prejudiced or bought off in some way. But if the Commission receives enough complaints about a judge, it will finally take note, and ultimately the judge can be penalized in some way and even removed from the bench.
